Preparation, filing, examination, and publication
Before the filing can be carried out, we first collect all the necessary data; name of the assignee, the brand itself, and which products and/or services it will be used for. All products and services are divided into 45 classes. A fixed fee applies for the submission of a trademark with one class. A surcharge is charged for each additional class. The filing date and number will be assigned upon submission. It is from this date that the 10-year protection period will apply.
In the next phase, an examination is carried out by the official office to check whether the trademark meets all the conditions. If no ground for refusal is found, the trademark will be published. Up to two months after publication, third parties can object to the registration of the registered trademark. For European brands, this is possible up to 3 months after the first day following the month of publication.
Registration
If no opposition is filed, the trademark is granted in the register. The registration certificate is drawn up. From the registration date, you are the holder of the trademark registration and you can exercise your rights.
